Zaftig Creative LLC uses information you share to run this website, fulfill orders, answer questions, and provide the updates you choose. Questions about your information? Email hi@zaftigcreative.com.
Orders, gifts, and accounts
When you order or use a customer account, we collect contact, billing, shipping, and purchase details. Payment providers collect the information needed to process your payment, and delivery providers receive the details needed to deliver your order. Phone numbers at checkout are optional.
Chai Five gift orders also collect the recipient’s name and mailing address, plus any gift message you include. Referral and share-kit choices are separate from a general newsletter signup.
Checkout may use Google Places to suggest shipping or billing addresses, sharing the address text you type with Google to return suggestions.
Forms and email
Our forms collect the details shown in their fields. The giveaway form asks for a name, email, and mailing address; its phone field is optional. Custom-order details may include design preferences and an optional phone number for discussing that order. We use responses to handle your request and the contact choices explained alongside it. You can unsubscribe from marketing emails using the link in the email.
Services that help us run Zaftig
Squarespace hosts our website, store, customer accounts, and newsletter signups. The giveaway form also uses Google Drive and our email inbox. The custom-order form uses Typeform. Adobe supplies website fonts, and Google reCAPTCHA checks forms for spam where enabled. These services may receive technical information needed to provide their functions and handle information under their own privacy practices.
Website visits and measurement
Squarespace receives browser, device, and network details, IP addresses, referring pages, and information about site activity, such as pages viewed, searches, and clicks. This supports website operation, security, and analytics.
We use Meta Pixel for advertising measurement. If you allow advertising cookies, Meta can receive information about pages and products you view, site searches, and shopping actions, including purchases. Meta processes this information under its own privacy practices. The Meta script may connect your browser to Meta before you make a cookie choice; advertising event tracking follows your advertising-cookie preference.
Cookie choices
Necessary cookies keep the website and checkout working. Use Accept all, Decline all, or Manage cookies to choose optional cookies, and Cookie Preferences to revisit your choices. These controls apply to Squarespace cookies and supported integrations; other providers’ embedded services may use their own technologies and privacy practices.
Questions and requests
Email hi@zaftigcreative.com to ask about, access, correct, or request deletion of your information. We may need to confirm your identity, and some information may need to be kept for orders, recordkeeping, or other legal obligations. If you follow an external link, that provider’s privacy practices apply there.
Shopping & website terms
Last updated October 12, 2026
Zaftig Creative LLC (“Company,” “we,” “us,” or “our”), registered in North Carolina (Raleigh), operates www.zaftigcreative.com (the “Site”). These terms (the “Legal Terms”) cover the Site and the related products and services that refer to them (the “Services”).
By accessing or using the Services, you agree to these Legal Terms. If you do not agree, do not use the Services. Product descriptions, written project agreements, and terms provided with a particular offer also apply. Nothing here excludes rights or remedies that the law does not allow us to exclude.
Questions? Email hi@zaftigcreative.com.
1. Orders and payment
Prices are in U.S. dollars. Checkout shows available payment methods and applicable tax and shipping charges. Keep your purchase, account, and payment information complete, accurate, and current.
By placing an order, you agree to pay its charges and authorize us to charge your chosen payment method. Use only a payment method you are authorized to use.
Availability and screen colors can vary. We may correct listing or pricing errors, including after payment, subject to applicable law. We may change prices and refuse, limit, or cancel orders, including quantities per customer, household, payment method, or address and orders that appear to be for resale or distribution.
2. Shipping and order help
We aim to ship ready-made goods within five business days. Custom orders follow the timeline agreed for your project.
Shipping means dispatch, not arrival. Chai Five follows the mailing schedule stated in its offer.
For delayed orders, we will provide the notice, choice about waiting, and refunds required by law.
3. Returns and cancellations
Ready-made goods are final sale for change-of-mind returns. This does not affect remedies required by law.
For questions about a cancellation, custom order, Chai Five, or an order that is late, damaged, incorrect, or missing, email hi@zaftigcreative.com with your order number and what happened. Any applicable terms in your project agreement or specific offer also apply.
4. Custom work and artwork
Custom totes have a minimum order of four totes sharing one design. That minimum does not apply to ready-made totes.
Your written project agreement sets out the work, price, payment, timing, revisions, approvals, and design rights. An inquiry is not an order. Changes to the agreed work, price, or timing need written agreement.
You retain your rights in project material you supply and represent and warrant that you have permission for us to use it. You authorize us to reproduce, adapt, and share it with necessary production providers for your project. Any broader rights belong in your project agreement.
Check names, spelling, dates, dimensions, and layout before approving a proof. Approval does not excuse a failure to produce the agreed result.
Zaftig and its licensors retain the rights in the Site’s content, designs, photographs, software, names, and logos. Subject to these Legal Terms, you may access the Site and download or print content you are entitled to access for personal, noncommercial, or internal business use. Other commercial use needs our prior written permission unless an offer or agreement expressly allows it. Keep required ownership and copyright notices with any permitted reproduction.
Buying an item does not transfer copyright or permission to reproduce its design for sale. We reserve rights not expressly granted; infringement is a material breach and ends your permission to use the Services.
5. Chai Five and surprise goods
The 2026 Chai Five Founding Season is a one-time purchase for five surprise mailings across October–December 2026, not an automatically renewing subscription. Zaftig chooses the contents.
The offer states its price, schedule, eligibility, and gift or referral conditions. Paid gift memberships and earned referral rewards are separate; these general terms do not change either offer.
Other surprise assortments contain the item count promised in the listing, with designs chosen by Zaftig. Any promise of different designs applies within one assortment; separate assortments may overlap.
6. Using the Site and sharing feedback
The Services are for people age 13 or older. Minors need a parent or guardian’s permission and direct supervision, and that adult must read and agree to these Legal Terms.
By using the Services, you represent and warrant that your information is complete, accurate, and current; you will keep it updated; you have the legal capacity or required parental permission to use the Services; and your use complies with these Legal Terms and applicable law. Keep your password confidential and your account secure.
Do not use the Services for fraud, impersonation, harassment, spam, unauthorized advertising, infringement, unlawful collection of private information, malicious software, security circumvention, or disruption. Do not remove proprietary notices, copy or reverse-engineer Site software except as allowed by law, sell your account, use purchasing agents, or exploit the Services for unauthorized commercial purposes. Except for ordinary browser or search-engine activity, automated access, scraping, and data mining require permission.
We may monitor and manage the Services, restrict access, remove content, or suspend or terminate accounts at our discretion, including for inaccurate information or violations. After suspension or termination, do not create a replacement account under your name or anyone else’s. We retain the right to take legal action.
You remain responsible for material you submit and for the rights and permissions it requires, including any required consent from people depicted. Suggestions about improving the Services may be used and shared without compensation; this does not transfer ownership of your project material or reviews.
Reviews should reflect firsthand experience. Honest reviews, including negative ones, are welcome and remain yours. We may moderate unlawful, harassing, abusive, discriminatory, privacy-invading, irrelevant, or clearly false or misleading content—not an opinion simply because we disagree.
Reviews are not endorsed by us, and do not necessarily represent our opinions or the views of any of our affiliates or partners. We do not assume liability for any review or for any claims, liabilities, or losses resulting from any review.
By posting a review, you hereby grant to us a perpetual, non-exclusive, worldwide, royalty-free, fully paid, assignable, and sublicensable right and license to reproduce, modify, translate, transmit by any means, display, perform, and/or distribute all content relating to the review.
7. GOVERNING LAW
These Legal Terms and your use of the Services are governed by and construed in accordance with the laws of the State of North Carolina applicable to agreements made and to be entirely performed within the State of North Carolina, without regard to its conflict of law principles.
8. DISPUTE RESOLUTION
Informal Negotiations
To expedite resolution and control the cost of any dispute, controversy, or claim related to these Legal Terms (each a "Dispute" and collectively, the "Disputes") brought by either you or us (individually, a "Party" and collectively, the "Parties"), the Parties agree to first attempt to negotiate any Dispute (except those Disputes expressly provided below) informally for at least thirty (30) days before initiating arbitration. Such informal negotiations commence upon written notice from one Party to the other Party.
Binding Arbitration
If the Parties are unable to resolve a Dispute through informal negotiations, the Dispute (except those Disputes expressly excluded below) will be finally and exclusively resolved by binding arbitration. YOU UNDERSTAND THAT WITHOUT THIS PROVISION, YOU WOULD HAVE THE RIGHT TO SUE IN COURT AND HAVE A JURY TRIAL. The arbitration shall be commenced and conducted under the Commercial Arbitration Rules of the American Arbitration Association ("AAA") and, where appropriate, the AAA’s Supplementary Procedures for Consumer Related Disputes ("AAA Consumer Rules"), both of which are available at the American Arbitration Association (AAA) website (http://www.adr.org). Your arbitration fees and your share of arbitrator compensation shall be governed by the AAA Consumer Rules and, where appropriate, limited by the AAA Consumer Rules. The arbitration may be conducted in person, through the submission of documents, by phone, or online. The arbitrator will make a decision in writing, but need not provide a statement of reasons unless requested by either Party. The arbitrator must follow applicable law, and any award may be challenged if the arbitrator fails to do so. Except where otherwise required by the applicable AAA rules or applicable law, the arbitration will take place in Wake, North Carolina. Except as otherwise provided herein, the Parties may litigate in court to compel arbitration, stay proceedings pending arbitration, or to confirm, modify, vacate, or enter judgment on the award entered by the arbitrator.
If for any reason, a Dispute proceeds in court rather than arbitration, the Dispute shall be commenced or prosecuted in the state and federal courts located in Wake, North Carolina, and the Parties hereby consent to, and waive all defenses of lack of personal jurisdiction, and forum non conveniens with respect to venue and jurisdiction in such state and federal courts. Application of the United Nations Convention on Contracts for the International Sale of Goods and the Uniform Computer Information Transaction Act (UCITA) are excluded from these Legal Terms.
In no event shall any Dispute brought by either Party related in any way to the Services be commenced more than one (1) years after the cause of action arose. If this provision is found to be illegal or unenforceable, then neither Party will elect to arbitrate any Dispute falling within that portion of this provision found to be illegal or unenforceable and such Dispute shall be decided by a court of competent jurisdiction within the courts listed for jurisdiction above, and the Parties agree to submit to the personal jurisdiction of that court.
Restrictions
The Parties agree that any arbitration shall be limited to the Dispute between the Parties individually. To the full extent permitted by law, (a) no arbitration shall be joined with any other proceeding; (b) there is no right or authority for any Dispute to be arbitrated on a class-action basis or to utilize class action procedures; and (c) there is no right or authority for any Dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.
Exceptions to Informal Negotiations and Arbitration
The Parties agree that the following Disputes are not subject to the above provisions concerning informal negotiations binding arbitration: (a) any Disputes seeking to enforce or protect, or concerning the validity of, any of the intellectual property rights of a Party; (b) any Dispute related to, or arising from, allegations of theft, piracy, invasion of privacy, or unauthorized use; and (c) any claim for injunctive relief.

10. LIMITATIONS OF LIABILITY
IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE LESSER OF THE AMOUNT PAID, IF ANY, BY YOU TO US DURING THE SIX (6) MONTH PERIOD PRIOR TO ANY CAUSE OF ACTION ARISING OR $100.00 USD. CERTAIN US STATE LAWS AND INTERNATIONAL LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS.
11. INDEMNIFICATION
You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of: (1) use of the Services; (2) breach of these Legal Terms; (3) any breach of your representations and warranties set forth in these Legal Terms; (4) your violation of the rights of a third party, including but not limited to intellectual property rights; or (5) any overt harmful act toward any other user of the Services with whom you connected via the Services. Notwithstanding the foregoing, we reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate, at your expense, with our defense of such claims. We will use reasonable efforts to notify you of any such claim, action, or proceeding which is subject to this indemnification upon becoming aware of it.
12. Other website terms
We may change or discontinue Site content or functionality, including for maintenance, without notice. Availability, ongoing support, and uninterrupted access are not guaranteed. The disclaimer and limitations above apply to downtime and third-party services.
We may update these Legal Terms by posting a revised version with a new date. Review them periodically. To the extent permitted by law, continued use after an update means you accept the revised terms; any notice required by law will still be provided.
Third-party websites and content
Links and material from other providers (“Third-Party Websites” and “Third-Party Content”) are not endorsed or independently verified by us. Their own terms and privacy practices apply. Purchases made with another provider are between you and that provider.
You agree and acknowledge that we do not endorse the products or services offered on Third-Party Websites and you shall hold us blameless from any harm caused by your purchase of such products or services. Additionally, you shall hold us blameless from any losses sustained by you or harm caused to you relating to or resulting in any way from any Third-Party Content or any contact with Third-Party Websites.
Privacy
We care about data privacy and security. By using the Services, you agree to be bound by our Privacy Policy posted on the Services, which is incorporated into these Legal Terms. Please be advised the Services are hosted in the United States. If you access the Services from any other region of the world with laws or other requirements governing personal data collection, use, or disclosure that differ from applicable laws in the United States, then through your continued use of the Services, you are transferring your data to the United States, and you expressly consent to have your data transferred to and processed in the United States. Further, we do not knowingly accept, request, or solicit information from children or knowingly market to children. Therefore, in accordance with the U.S. Children’s Online Privacy Protection Act, if we receive actual knowledge that anyone under the age of 13 has provided personal information to us without the requisite and verifiable parental consent, we will delete that information from the Services as quickly as is reasonably practical.
Your data
You are responsible for the data you submit to the Services.
You agree that we shall have no liability to you for any loss or corruption of any such data, and you hereby waive any right of action against us arising from any such loss or corruption of such data.
Electronic communications, transactions, and signatures
Visiting the Services, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications, and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically, via email and on the Services, satisfy any legal requirement that such communication be in writing. YOU HEREBY AGREE TO THE USE OF ELECTRONIC SIGNATURES, CONTRACTS, ORDERS, AND OTHER RECORDS, AND TO ELECTRONIC DELIVERY OF NOTICES, POLICIES, AND RECORDS OF TRANSACTIONS INITIATED OR COMPLETED BY US OR VIA THE SERVICES. You hereby waive any rights or requirements under any statutes, regulations, rules, ordinances, or other laws in any jurisdiction which require an original signature or delivery or retention of non-electronic records, or to payments or the granting of credits by any means other than electronic means.
General provisions
These Legal Terms and any policies or operating rules posted by us on the Services or in respect to the Services constitute the entire agreement and understanding between you and us. Our failure to exercise or enforce any right or provision of these Legal Terms shall not operate as a waiver of such right or provision. These Legal Terms operate to the fullest extent permissible by law. We may assign any or all of our rights and obligations to others at any time. We shall not be responsible or liable for any loss, damage, delay, or failure to act caused by any cause beyond our reasonable control. If any provision or part of a provision of these Legal Terms is determined to be unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these Legal Terms and does not affect the validity and enforceability of any remaining provisions. There is no joint venture, partnership, employment or agency relationship created between you and us as a result of these Legal Terms or use of the Services. You agree that these Legal Terms will not be construed against us by virtue of having drafted them. You hereby waive any and all defenses you may have based on the electronic form of these Legal Terms and the lack of signing by the parties hereto to execute these Legal Terms.
